HUD Housing Counseling

Anyone requiring HUD housing counseling should jump in now before budget cuts obliterate the program later this year. Remember the looming government shutdown in early April? Well, the Republicans and Democrats decided one way to balance the budget was to slash HUD funding for counseling services that have helped thousands of homeowners avoid foreclosure.

I've referred many people to HUD housing counseling. Especially, those participating in Obama's Making Home Affordable program. MHA originated in 2009 as a way to help "millions" of homeowners stay in their home via loan modification. The program hasn't been very successful and is likely to be scraped as well.

Improper Foreclosure

Improper foreclosure is something you'll be hearing about a lot. The media is abuzz over bank regulators launching a plan to provide monetary compensation to homeowners whose homes were illegally seized.

Improper foreclosure occurs when banks do not have proper mortgage assignment documents. In recent weeks, much has been publicized about mortgage lenders hiring robo-signers to forge signatures on loan documents; allowing banks to foreclose via fraudulent means.

Short Sale Eligibility

To fully explain short sale eligibility would almost require a book. The only established criterion is Home Affordable Foreclosure Alternative (HAFA) short sale program offered through U.S. government. All other programs requirements vary by lender.

HAFA short sale eligibility encompasses multiple factors. However, meeting each of the factors does not guarantee acceptance into the program. Instead, final decisions rest with the mortgage service provider.

Basic requirements for obtaining short sale approval under the HAFA program include:

1. Living in the home within the previous 12 months.
2. No real estate purchases made within previous 12 months.
3. Principal balance of first mortgage does not exceed $729,750.
4. First mortgage taken out prior to January 1, 2009.
5. Ability to provide documented financial hardship.
6. Property owner never convicted of certain types of felony crimes within the last 10 years.

Home Foreclosure

Home foreclosure continues to plague Americans, with one of every 385 homeowners receiving notice of default in 2009. By now, everyone knows that Wall Street, subprime lending practices, and skyrocketing unemployment has clouded the American Dream of homeownership. The question remains, is there an end in sight?

Mortgage financiers and government agencies publish conflicting home foreclosure information. Some sources claim bank foreclosures are lessening, while others report the number of foreclosure properties will continue to rise through 2010.

Broker Price Opinion

Broker Price Opinion refers to the process used to obtain property values. Mortgage lenders and bank loss mitigation departments utilize BPO reports in lieu of traditional property appraisals to obtain estimated property values of real estate which is entering into foreclosure or when borrowers wish to obtain a loan modification.

Broker Price Opinion is not the same as a traditional property appraisal. As the name suggests, the appraised value is an opinion based on a variety of predetermined factors. These can include the area where the property is located, square footage of the home, lot size, and the condition of other homes in the area; including the percentage of foreclosure or bank owned properties.

Avoid Foreclosure

If you need to avoid foreclosure, you don't have any time to waste. Although lenders are doing their best to help financially-strapped borrowers keep their house, there are only so many options available. Unless you have the financial means to cure mortgage arrearages and stay on track, you might not be able to stop the foreclosure process.

There are steps you can take to avoid foreclosure, but you must take immediate action. If you haven't already done so, now is the time to contact your mortgage lender. The longer you procrastinate, the harder it will be to convince your lender to work with you.

Foreclosure

Foreclosure rates are skyrocketing and millions of Americans are facing the very real possibility of losing their home. Many homeowners are choosing to walk away from their house because they can no longer afford to pay high-interest mortgage notes on real estate which is now worth less than it was when they purchased it.

Foreclosure is also affecting numerous unsuspecting tenants. Oftentimes, homeowners rent their distressed property in hopes of being able to retain their property. If they end up losing their home to foreclosure, tenants are forced to move and generally end up losing their security deposit and advanced rent monies.
